Sain eilen tietää sivustosta nimeltä TinEye, jonka avulla voi etsiä samanlaisia ja alkuperäisestä muunneltuja kuvia netistä. Järkytyksekseni havaitsin, että yksi henkilökohtainen työni oli joutunut luvattoman käytön kohteeksi. Kanadalainen indie rock -superyhtye The New Pornographers, joka levyttää Matador Recordsille, oli käyttänyt kuvitustani “Taming of Women” CD-singlensä kannessa niin, että sitä oli vieläpä käsitelty (kaiken lisäksi erittäin huonosti).

CD on julkaistu 2007, eikä yhtye tai heidän levy-yhtiönsä ole missään vaiheessa ole ollut yhteydessä minuun kysyäkseen lupaa kuvan käyttämiseen, korvauksista puhumattakaan. Levyn takakannessa sanotaan: “Despite our best efforts to locate the source of this cover image we use this artwork without permission and with extreme gratitude to you, mysterious artist.”. Tällainen ilmoitus ei anna mitään oikeutta varastaa ja manipuloida kuvaa, etenkään kaupalliseen tarkoitukseen. Heidän asenteensa on varsin röyhkeä. Kirjoitan tänne enemmän, kunhan asiaan tulee selvyyttä.

Yesterday I learned of a web page called TinEye, which – according their own description – “finds out where an image came from, how it is being used, if modified versions of the image exist, or if there is a higher resolution version.” To my shock I found out that one of my personal illustrations was used without my authorization. A Canadian indie rock supergroup The New Pornographers, whose record company is Matador Records, has used my illustration “Taming of Women” on their CD single cover. The picture was also manipulated (and very badly too).

The CD was released in 2007 and I have not received any contact from the band or their record company for permission to use my work or compensation for it. Instead, on the back cover of their CD they printed: “Despite our best efforts to locate the source of this cover image we use this artwork without permission and with extreme gratitude to you, mysterious artist.” This kind of notification is naturally not enough to give them the authorization to use my illustration, especially for commercial purposes. Their attitude is clearly very arrogant. I will blog more when I have investigated the matter more deeply.

    Hope you obtain your royalties. However, I don’t really see the arrogance you described.

    I have to admit to erring on the side of the band here, assuming that they really went out of their way to track down the copyright holder of the image.

    They tried, failed and then they stuck with the image anyway. It’s not the safest decision around, yet I find it commendable in the face of the usual psychotic carefulness. Too bad it’s a bad song and the photoshopping’s so bad.

    Whether they really tried to track him down is irrelevant; the whole point of copyright is that the artist gets to control his work and where it’s being used. The entire concept of permission becomes meaningless if it’s just a matter of convenience, and I do think it’s arrogant to presume that the artist would give permission if they only could have contacted him.

    It also strikes me as amazingly stupid — I’d imagine that if this ended up in court, it wouldn’t turn out well for them when they admit that they don’t have permission to use the image in the same place where they use the image. That kind of thing could end up being a lot more expensive than just paying for the use of the image.
